Village of BeulahRegular Council Meeting called to order by President Baltazar on Thursday, March 9, 2006 at 6:30 P.M.

Roll Call: Present: President Baltazar, Trustees Milliron, Pallin, Siderman, Belanger, Elliott, Clerk Hansen, Treasurer Gerberding, ZA Charles Kinzel and Supt. Moore. Excused: Trustee Rank
Pledge of Allegiance was voiced by all in attendance.
Additions to Agenda: Benzie Utilities; Auto Locks on Welcome Center Building; Waste Water Task Meeting and Post Office Meeting.
No conflict of interest reported by any council member.

Motion by Elliott, support Belanger to approve the Agenda as presented. All Ayes. Motion Carried
Motion by: Siderman , support Belanger to approve the minutes of the regular council
meeting of Thursday, February 9, 2006. RC Vote All Ayes. Motion Carried.
Motion by Belanger, support Siderman to approve the bills for February, 2006 and March, 2006 as presented. RC Vote: Ayes - Elliott, Belanger, Baltazar, Siderman, Pallin, Milliron. Nays: None Excused: Trustee Rank Motion Carried.
Communication to Council: Motion by Elliott, support Milliron to close regular council meeting at 6:40 pm and go into closed session to discuss Mediation Settlement Agreement - A through Z Company and Village of Beulah. In attendance President Baltazar, Trustees Elliott, Belanger, Siderman, Pallin, Milliron, Clerk Hansen, ZA Kinzel and Attorney David Bedells. Excused Trustee Rank. Roll Call Vote. All Ayes. Motion Carried. At 7:25pm a motion by Elliott, support Milliron to adjourn closed session meeting and reconvene to regular council meeting. All Ayes. Motion Carried.
Committee Reports: Treasurer - Kim Gerberding: Motion by Milliron, support Belanger to approve Treasurer’s Report dated 3/1/06 as presented. All Ayes. Motion Carried.
Delinquent Water/Sewer report dated 3/8/06: 27 Delinquent water bills in the amount of $3,583.39. Certified letters being sent 3/11/06. Shut off date 3/23/06. One Personal Property Tax - Pine Knot Resort in the amount of 136.88. Small claim date to appear in court is 3/20/06. Siderman will attend court for Treasurer.
Zoning Administrator - Charles Kinzel: Presented two draft additions to Village of Beulah Zoning Ordinance. 9.6 D Short Draft. Electronic Message Display. Discussion held. Present electronic sign on US 31 is in violation of our Ordinance. Number one, the property owner has not requested a permit to put up present sign and second it is not on Brookside property, it is adjacent to Brookside. If owner had followed the requested procedure, he would be legal, but owner did not. Motion by Elliott, support Siderman we do not approve adding Electronic Message Display Signs to our Ordinance for approval of publication. Roll Call Vote: Ayes: Pallin, Siderman, Elliott Nays: Belanger, Baltazar, Milliron. This will be tabled until April 6, 2006 council meeting
Elliott asked if Central State Bank removes present sign by rebuilding or addition, if sign comes down the grandfather clause will be eliminated. Kinzel stated correct.
Water/Sewer - Trustee Rank: Baltazar reported for Rank. A grant was approved in the amount of $2.4 million dollars for public works (water/sewer) improvement.. News received from Rep. Pete Hoekstra, Washington, DC. Siderman commented he was asked about the grant and as a council member I did not know anything about it. Nothing worse than being a council member and having to say I know nothing about it. Someone should have informed the council members to let us know what was happening. Baltazar stated he did not put the information in the paper, put in by Department of Agriculture, not me. USDA printed this not us. Rank, Engineers and myself spent many hours working toward getting this grant loan. Baltazar stated he was asked not to mention grant, will be notified in the paper of approval by USDA . Elliott stated she had wished Hoekstra announced the approval of grant money in Village of Beulah instead of in the City of Frankfort.
Law-Finance: Trustee Siderman No report
Halls/Grounds: Trustee Belanger No report
Parks/Recreation: Trustee Elliott: Elliott reported a check was received from Jed Myers (his son) for Basil Myers dock rental for summer of 2006. Should I have a check from Basil Myers - council agreed to accept check written by Jed Myers.
Motion by Elliott, support Siderman to approve the following applications for Dock/Hoist for summer 2006: 21 names: Brauer, Branstrom, Loll, Olney Don, Tims, Olney, Jeff, Belanger, Patrick, Gidley, Laso, Myers, Barbara, Tipton, Antel, Luginbill, Spillane, Malecki, Conquest, Quick, Myers, Basil, Long & Wilson, Harley and Cole.
All Ayes. Motion Carried. Boat registrations are due no later than May 16, 2006.
M/M Wassa have been notified they are next on waiting list for Dock/Hoist application.
Rental of Pavilion: Elliott believes as a village the people using the Park/Pavilion are taxpayers and I don’t want to proceed with a rental program for the usage of the park. I am asking do we want to set a fee and rent it, or have it open to the public, not just Village of Beulah taxpayers. The larger associations will be asked to present an Insurance Binder for the Village of Beulah files.
Streets: Trustee Milliron: Application for light to be installed on Crystal Avenue has been submitted. Lights installed now will not shine in any home in the area.
Equipment: - Trustee Pallin The replacement quote for a Case/Back hoe from Hyde Equipment if for information only. The one for the Village is being repaired and we are presently leasing one from Hyde Equipment. Parts are getting hard to find for repairs.
Superintendent Moore: A pot hole right outside Easy Mart. Moore stated he was aware of it, but cannot purchase asphalt until warmer weather as they are not making it as yet.
Sewer pump on Crystal Avenue went down again over last week-end. We really need a spare pump. Richland stated (after quite a talk) said they would repair the pump. It will be at least four weeks for repair. Approximately cost of $12,000.00 for a spare pump. Will check other options regarding a spare pump. Our back0up would be Crystal Pumping, Ken-Jac Pumping, Bonney Brothers. Would dump at our sewer ponds. This should be top priority as the pumps are 45 years old.
Price for Orange barrel cost is $113.80 plus shipping. Mr. Lorenz and Mr. Bryan Cosby will be billed for meter cover 18” ID Lid and Cosby will also be billed for orange barrel fee.
Have one pond #5 that is still empty, starting using Pone #4. May 1 can start spraying.
David Egeler attended Sewer Lagoon Class. Examination in May, 2006 for Lagoon license. Egeler is also registered for water license.
Baltazar will discuss with Supt. Moore regarding John Huntley obtaining water license.
Been working/painting in the lift stations.
Correspondence: Beulah Library requested the use of Trailhead Building July 4, or July 8, 2006. Motion by Elliott, support Siderman the Trailhead Building to be used for the purpose as a Visitors Welcome Center not for organizations to utilize it for special events. Roll Call Vote: Ayes: Siderman, Baltazar, Elliott, Milliron, Pallin Nays: Belanger Motion Carried.
Discussion held regarding time/day 9of usage of the park. Do not reserve as such except Art Fair - first come, first serve. Elliott will prepare a form for usage of the park.
Elliott will discuss with Debbie Eckhout regarding Vendor’s on the street and let her know the Village has not given support, but we have no zoning ordinance and council is not going to take any action.
Benzie County Sheriff’s 2006 Benzie County Marine Safety Program. Discussion held and consensus of Council, not to participate.
Information Booth: Ms Eckhout complained regarding snow being piled (barricaded). Starting to flood and ruin everything in building. CLCBA will be informed to remove what is needed before winter as not to interfere with Village of Beulah snow plowing. Belanger will check on building condition and report at the April, 2006 council meeting .
NW MI Onsite Wastewater Task Force: Supt. Moore will attend the on-site sewage issues in the Benzonia area Wednesday, March 15, 2006 at 6:00pm.
Baltazar stated the need for Auto-Locks for Trailhead Building for a quote of $1,317.00. Will check with Rotary to purchase the locks. At present time no one is designated to open and close the Trailhead Building. The alarm locks are auto-matic. Discussion regarding the usage of building. No information posted on the outside informing the people of the restrooms are available on the inside and that the building is the Welcome Center Building.

MI Land Institute to hold meeting on March 15, 2006 regarding keeping the Post Office in Village of Beulah downtown area.
Moore reported he had problems with a person during Winterfest in regards to
the parking situation.
Public Input: Suggestion the workers wear ID Jackets/Vests so people are aware they are associated with the Winterest Program and directing traffic. Businesses would like to know if roads closing during water/sewer construction.
We are taxpayers and trying to run our business and not to make it permanent for Vendor’s to come in and sell their wares during special events in the Village.
