Minutes of Regular Council Meeting of Thursday, May 4, 2006 7:30 P.M.

Village of Beulah

Regular council meeting called to order by President Baltazar.

Visitors: 7

Roll Call: Present: President Baltazar, Trustees Milliron, Pallin, Siderman, Belanger, Elliott, Rank, Clerk Hansen, Treasurer Gerberding, Z.A. Charles Kinzel and Supt. Moore.

No additions to the presented agenda.

No conflict of interest reported by any council member.

Motion by Rank, support Siderman, to approve the Agenda as presented. All Ayes. Motion Carried.

Motion by Belanger, support Milliron to approve the minutes of the regular council meeting of Thursday, April 6, 2006 as presented. RC Vote All Ayes. Motion Carried.

Motion by Rank, support Elliott to approve the bills for April, 2006 and May, 2006 as presented. RC Vote All Ayes. Motion Carried.

No public comments on Agenda items only.

Communication to Council: Carolyn Kelly presented a petition to keep the Beulah Post Office in the downtown area. Belanger informed her that at our April, 2006 meeting a motion to keep the US Post Office in the downtown area and carried the support of all council members.

Barbara Myers concerned regarding the location of her boat dock. After lengthy discussion, council stated that the problem be solved between Mrs. Myers and Trustee Elliott.

Sheriff Patrol Agreement: Motion by Belanger, support Siderman to accept the agreement submitted by Benzie County Sheriff Department. Grand total for summer hours will be 200 hours at $41.06 per hour for a total of $8,212.00. RC Vote All Ayes. Motion Carried.

Conservatory Letter: Motion by Rank, support Elliott to give permission to Grobbel Environmental to perform the work in the sedimentation basin to clear sediment from entrance way of the sedimentation basin.. No cost to the Village of Beulah. RC Vote All Ayes. Motion Carried.

Committee Reports: Treasurer’s Report - Kim Gerberding: Motion by Elliott, support Rank to approve Treasurer’s Report dated 05/02/-6 as presented. All Ayes. Motion Carried.

Personal Property Tax - Pine Knot Resort Bradley Reecer - $138.12. Court Date: May 25, 2006

Trustee Siderman will attend. Water bills due Monday, May 15, 2006.

Letter from Tim Warner: Recommendation and support of Council to inform Mr. Warner that the water did go into the sewer, therefore, the bill stands as presented and no refund or adjustment to the bill.

Z.A.Kinzel: Reported the Company of Freedom Financial did not formally request to put up sign. Baltazar states I gave verbal approval to put sign up and not to light the sign and did not light the sign only to test the sign and then turn it off. Kinzel stated it was on for at least 36 hours. Why was permission granted without owner going through proper channels. Baltazar stated he applied but was denied a permit by Z.A. Kinzel.

Law/Finance - Trustee Siderman: Deadline for filing for November 7, 2006 election must be filed by August 15, 2006 - 4pm at Benzonia Township Office.

Water-Sewer - Chairman Rank: Motion by Rank, support Siderman to raise water rate usages per 1,000 gallons from $2.75 to $3.00 and sewer usage rates from $2.75 to $3.00 per 1,000 gallons. RC Vote All Ayes. Motion Carried. Effective October, 2006.

Motion by Rank, support Milliron to raise new />< hook-up fees from $1,000.00 to $1,500.00 for water and $1,500.00 for sewer. RC Vote. All Ayes. Motion Carried. Effective October, 2006.

Halls/Grounds: Trustee Belanger: Auto locks installed. Will check as only one door has auto locks and quote was for two doors. Paint to be purchased for Information Booth. Will check price of timer for lights in the Welcome Center Building. Signs for the North and South end of the Village are being made.

Parks/Recreation - Trustee Elliott: Reported received one bid to resurface two tennis courts and the asphalt slab at a cost of $8,962.00. This will be paid out of Public Improvement Fund.

Will have locked gates going into tennis court at the Village of Beulah park and have a walk through on the beach side. Hopefully will keep skateboarders off the tennis court.

A child was injured on the skateboard facilities in Trapps Park. It took surgery (3 hours) to remove splinters. Motion by Elliott, support Rank to use money from Public Improvement Fund to purchase Skate-Lite for ½ pipe for a cost of $5,000.00. RC Vote All Ayes. Motion Carried. Belanger stated consideration should be taken regarding Fair’s Park as the shoreline is eroding and would like to see money spent that way instead of spending $8,200.00 for skateboard material.

Streets - Trustee Milliron: Getting the pot holes filled. Two bids for resurfacing Hill Street and a portion of Crystal Avenue. Brown’s Bid: $25,038.00 Quality Asphalt: $14,195.00 Motion by Siderman, support Belanger of accept Quality Asphalt bid of $14,195.00. RC Vote All Ayes. Motion Carried.

Supt. Moore: Started irrigation at ponds, flush water mains May 8 9, 2006. Trailer Park ready to open, might need more pallets. Putting in water meters. David Egeler and John Huntley took water test for S-4 license. Test results around July, 2006.]

Letter of Resignation: Charles Kinzel: Motion by Rank, support Elliott to rescind letter of resignation from Charles Kinzel. All Ayes. Motion Carried Kinzel will stay as Zoning Administrator.

Belanger stated he would like to see the Council respect the ZA Administrator’s position to the point where any decision to be made by the Council and not by any one individual of the Council and we try and support Charley’s job as much as possible and would like to see the Council not over step our bounds individually and act as a unit. We are entitled to disagree and propose opinions, but when it come to action or not action we need to follow procedures and make sure things are done properly.

Library Update: Anne Damm reported preliminary bids opening for new library building will be May 23, 2006.

New Business: Siderman stated in between Public Hearing Meeting and Regular Council Meeting Siderman, Baltazar, Belanger and Kinzel were verbally attached by a resident of the Village of Beulah at the table. No humor in it, we have to get a hold of the meetings so this does not happen again. He attached all of us verbally and no place for that kind of talk at a council meeting. We have to make sure this does not happen ever again. Very abusive. Announcement by President no approaching the table and start holding our guidelines to two minutes (when the agenda states two minutes).

Public Input: Norm Leer would like marking or signs so the dumpster can be emptied on Fridays. A parking space would be eliminated. Street Administrator Milliron informed him no to his request.

Moore said the ZA job is a thankless one, but thanks for the job you are doing.

Motion by Belanger, support Rank to adjourn this meeting at 9:30 P.M. All Ayes. Motion Carried.
