Minutes of Regular Council Meeting Minutes of Thursday, July 6, 2006 - 7:00 PM Regular council meeting called to order by President Baltazar Visitors: Four Roll Call: Present: President Baltazar, Trustees Rank, Elliott, Belanger, Siderman, Pallin, Milliron, Z.A. Kinzel, Clerk Hansen and Supt. Moore Pledge of Allegiance voiced by all in attendance Norman Leers was added to the agenda No conflict of interest reported by any council member. Motion by Elliott, support Rank to approve the Agenda as presented with the additional adding of Norman Leers. All Ayes. Motion Carried Motion by Belanger, support Rank to approve the minutes of the regular council meeting of Thursday, June 8, 2006 as presented. RC Vote All Ayes. Motion carried Comments were made by President Baltazar in regards to the comments stated in the June 8, 2006 minutes. Council discussed the comments and stated they were misinterpreted as to the meaning of the comments. Motion by Siderman, support Rank to approve the bills for the month of June, 2006 and July, 2006 as presented. RC Vote All Ayes. Motion carried. No public comment at this time. COMMUNICATION TO COUNCIL: Kyle Axtell - Benzie Conservation District Outreach Coordinator: I am here today to ask the council for your support on a grant project No financial support on the Village of Beulah’s part. Letter presented (attached) asking for support from the Village of Beulah Council. Motion by Siderman, support Rank to support the grant project request and will allow the purchase of new equipment that is needed as the present equipment is obsolete and not in working order as parts are unavailable. All Ayes. Motion Carried. Norman Leers: Property Owner: Requesting driveway access to my property. Discussion pro/con on the subject. Legal opinion from the Village of Beulah attorney with what I am requesting a parking space , as parking gets heavy along Commercial Street and blocks our driveway. Leers is asking for painted lines to designate a no parking space. Leers is asking to block the space in front of the driveway, and to our knowledge I don’t know of any driveway that is marked with lines to designate no parking. Kinzel stated according to our Village Attorney, we cannot deny them a driveway through their property regardless what he uses it for: parking - garbage pick-up or whatever we cannot deny access to anyone’s access to their property from a public road. Rank asked if access be from the back of the property. Leer stated he has plans for that property and is separate from the property in question. Motion by Belanger, support Siderman the Mr. Leers is allowed to have access to his own property by a driveway. Discussion: Elliott asked what the attorney stated about marking off the area. - space. Kinzel said nothing is said about any markings, just access to his property by a driveway. No line are noticeable at this time. Rank asked regarding the area behind the buildings on Benzie Blvd. The Village has an 8’ easement from Commercial Street to Benzie Blvd. Roll Call Vote: Ayes: Pallin, Rank, Siderman, Belanger, Elliott: Nays: Milliron, Baltazar Motion Carried. Ask if a sign could be placed NO PARKING and will be discussed by President Baltazar and Supt. Moore as to the decision. COMMITTEE REPORTS: Motion by Rank, support Milliron to approve the Treasurer’s Report dated 06/30/06 as presented. All Ayes. Motion Carried. Letter of Resignation: Kim Gerberding Treasurer: Discussion held. Motion by Siderman, support Rank to accept resignation of Treasurer Gerberding effective July 1, 2006. RCVote: Ayes: Rank, Baltazar, Elliott, Milliron, Pallin, Siderman Nays: Belanger Motion Carried. Delinquent Water Bills: Two turn off water meters: Mr. Dickey paid the $100.00 turn on/off fee and water was turned back on. Mr. Renfro is still turned off. He had it turned off in November, 2005 and now we have a late water bill. Rank stated he owes the $100.00 fee for turn on/off. He still has to pay the ready to serve fee which is delinquent. The penalty is $100.00 for not paying his water bill. Personal Property Taxes: RE: Pine Knot Resort - Bradley Reecer: Case # 06-293-GC-2 is on Judge Danielson’s desk to be signed, Thursday, July 13, 2006 ordering Reecer to pay the personal property tax due in the amount of $135.65. Appointment of Treasurer: Motion by Rank, support Siderman to appoint Dawn Olney as Treasurer for the Village of Beulah immediately and until the election of November, 2006. All Ayes. Motion Carried. Welcome Dawn ………….. Zoning Administrator - Charles Kinzel: Four hours was spent in court last week and another hearing will be held Thursday, July 13, 2006 at 9:30 AM Clerk was subpoenaed and instructed to bring the original tapes from the November 10, 2006 council meeting to the court proceedings along with a tape recorder. Discussion was held regarding the sign located at Brookside. Clerk will type the motion from the minutes of November 10, 2005 and include the minutes/discussion with the July 6, 2006 minutes Will be working with Gosling Czubak updating our Zoning Ordinance and also our Master Plan . Budget for the Master Plan Update will be in the 2007 Budget.. Water/Sewer - Chairman Rank: Gosling Czubak are doing preliminary engineering on the three priority items: Tower, Sewer Main going out to sewer ponds and a new Well. Will have a report either in August, 2006 or September, 2006, where they stand on that. We will be holding public hearings so the residents are understanding what we are doing and what we will be doing in the future and not be a big surprise. Law/Finance - Trustee Siderman: To work with Trustee Elliott on rules/regulations for the Village of Beulah Park. Halls/Grounds - Trustee Belanger: New signs are being put up. Siderman likes the Logo on signs.. Village of Beulah maintenance will take down the old sign. Belanger asked Supt, Moore if he maintained the Welcome Center building all by himself on the 4th of July with all the other duties you had to do. The only time I did not keep up with the maintenance of the restrooms was during the parade. Belanger requested that John work to keep the bathroom area clean and supplies filled. Baltazar rejected my request. We had to deal with one person trying to do all the work necessary on the busiest day of the year, the 4th of July. Rank commented after sitting in the President’s chair for eight years in a row, directions for hourly people can only come from one person and that has to be the President because he knows the priority of the Village and he is the one that has to take the responsibility to see it is being done or not done. I know we had problems when I was President because there was three or four council members wanting to direct he hourly people and they did not know which way to go, so in fairness to Brian, Dave and John, they have to get direction from one person in my opinion. Belanger stated I totally agree, I was not trying to direct, only through Brian to talk to President Baltazar for permission because I think as trustees we also have to make recommendations regarding our own department. Rank said he misunderstood, thinking you, Mr. Belanger asked Brian to bring in another worker. Belanger asked Brian if it is a one man job, or two man job during the 4th of July celebration day or a zero man day. Brian suggested two men working for example, one work a half day in the AM and one working a half day in PM as my legs were so tired from walking all day, even tho’ I had my daughter helping me , it is too much for one person. I was whipped. I worked from 6:30 AM until 7:30 PM. Rank stated the men work for Jim (President Baltazar) and If Brian comes back to Jim and says I couldn’t get it all done, next year would you consider putting on another worker, and he would do it. Milliron helped take down the barricades after the parade. Belanger stated I am trying to get an answer, Mr. President do you think we should have one person on staff or two. President Baltazar stated he would take a look at it for next year. Parks/Recreation - Trustee Elliott: Elliott asked if she will be having maintenance worker from the Village clean the public restrooms and the trailer park restrooms/showers September 1st through September 30th. The manager of the trailer park is only there for the prime season, not available during the month of September. Discussion was held regarding the cleaning of both restrooms. Decision was made to keep the cleaning of the Beulah Beach Bathhouse and Trailer Park Bathhouse/Showers the same as it is being done at present time. Hire an outside company to do the cleaning for the month of September. Council agreed to hiring a cleaning company to do the cleaning during the shoulder season. Elliott reported there was a church group in the park on the 4th of July. They had approval from the CLBA to be there and singing, preaching ( with a Mike) quite loudly about Jesus and everything else, and as I walking through the park I hear comments fro individuals which was inappropriate. I think next year we need to be more involved with CLBA and want a copy of Zoning in reference to the Village of Beulah Park. Siderman suggested at our June, 2007 meeting to have a representative from the CLBA in attendance and must turn into the Council everything that is going to occur and we hold the right to veto. I don’t like a parade that is all political. We have to get more involved. Rank stated there is an Ordinance regarding selling from any public land and sales for profit is not legal. We have vendor’s wanting to sell hot dogs, popcorn on the beach and the Ordinance states you cannot do that. Siderman and Elliott will pursue the Ordinance relative to the selling of merchandise/food on public property in the Village of Beulah. Will allow the church group scheduled for Sunday, July 9, 2006 as it is too late to cancel. Street Administrator - Trustee Milliron: Motion by Siderman, support Rank to accept the bid from Five Star Flatworks replacing several different locations of sidewalk in the Village of Beulah at a bid of $10,000.00. Roll Call Vote: Ayes: Siderman, Baltazar, Belanger, Elliott, Milliron, Pallin, Rank Nays: None Motion Carried. The Village of Beulah will need PROOF OF INSURANCE from Five Star .Company. Equipment - Trustee Pallin: No Report Spt. Moore: Moore was concerned regarding statements made in the June, 2006 council meeting. Council discussion and was sorry Moore misunderstood the discussion and wanted Moore to know that the discussion in the June, 2006 minutes were no intentions toward him or the other employees. As Siderman said: It is not you, it is not me, it is the system. The form presented was to used only for people stopping Brian on the street requesting work to be done. Further study will be given as to a form to be used by the council members. David Egeler passed his water license.
