Council Meeting Minutes, Thursday, December 10, 2009

Meeting called to order by President Rank at 7:00 PM

Roll Call:  Cantrell, Hansen, Kilgus, Kinzel, Pallin, Rank, Siderman, Superintendent Moore, Treasurer Olney, Clerk Spencer

No conflict of interest voiced by any council members

Approval of the agenda - Motion by Kilgus, support by Hansen - All Ayes - MOTION CARRIED

Approval of Minutes for November 5, 2009 - Motion by Kinzel, support by Siderman - All Ayes - MOTION CARRIED

Review of bills for November/December 2009 - Motion by Kinzel, support by Hansen - Roll Call:  AYES:  Kinzel, Cantrell, Pallin, Rank, Kilgus, Hansen, Siderman - NAYES - NONE - MOTION CARRIED

Public comments:

Steve Wentworth - Christmas Magic on Saturday - sidewalks cleared - will help with volunteers

Communication to Council:

President Rank:

Boylan litigation - charging Village with negligence for water under her crawl space - there is no knowledge or evidence that a storm drain had ever been there - upon inspection by Rank, it was determined that there should be and 3 manholes have been placed - Boylan blames the Village for a mold problem in her crawl space - this issue has been turned over to our insurance company and lawyers - paperwork was obtained that there was standing water in the crawl space when the house was purchased - probable denial of the claim by the insurance company - unknown what further action will be taken

Introduction of Chris Adsit as a new employee - welcome

Jim Baltazar - Christmas Magic on Saturday, December 12 th - events have been advertised, this will include Santa, sleigh rides and a parade - cookie sale at the Trailhead Building , December 11 & 12

Treasurer Olney - Treasurers report reviewed - Motion by Hansen, support by Kinzel - All Ayes - MOTION CARRIED

Eight delinquent personal property taxes - letters have been sent - approximately $1000.00

Water/Sewer - Chairman Kilgus:  No report

Law/Finance - Chairperson Hansen:  Update on Capital Outlay - Recorder purchased for Clerk - shredder available in Office, open for public use - Benzie & Clark street, sidewalk repairs - storm drains placed on Clark St. & Spring Valley - loader repair -, $6200.00 and sewer jetter purchased

Building/Grounds - Chairman Siderman:  Bids will be put out next spring for new roof - 2 sets of bids, shingle and metal - thanks to Council and President for work done and staying  within budget

Equipment - Chairperson Cantrell:  Purchase of new truck with V-plow, thanks to Rank for negotiations - truck should be received January/February 2010

Streets/Sidewalks - Chairman Kinzel:  Several meetings with the Beulah Boosters on streetscape plan to help determine sidewalk and streetlight improvements - good input - need to develop a 5 year Parks/Rec plan to submit to obtain grants

Discussion of snow clearing on street and sidewalk clearing ensued

Parks/Rec - Chairman Pallin:  No report

Superintendent Moore:  Request to block off section of street for snow removal - approved - request ordinance or deadline for pulling meters for irrigation systems

Old Business:

Vicki Carpenter - Master Plan - Council needs to review and approve Master Plan - survey information has been widely distributed - Motion by Hansen, support by Cantrell that Council has reviewed the Master Plan with no changes but with the addition of the updated information - Roll Call:  AYES:  Pallin, Rank, Kilgus, Hansen, Siderman, Kinzel, Cantrell - NAYES - NONE - MOTION CARRIED

Rank - Thanks to Vicki and Phil for all the work they have done

Streetscape - support by groups - information /illustrations (by Diana Moss) distributed by Bob Bishop- Bishop turned over to Moss - did a review of the results of several meetings - preliminary work - theme and structure, signage on Spring Valley and St. Route 31- open to input

Thor Goff - Thoughts proposed on a beach boardwalk

Discussion ensued

Mark Hurley (Gosling Czubak) - grants have to be in by April - so Parks/Rec Plan needs to be done by February or early March

Bonnie Smith - when the Library improved (new building and space - the traffic increased tremendously)

Thanks by Jerry Rank for all the hard work people have done

New Business:

Request by the Sheriff's department for support for the Snowmobile Program - Motion by Cantrell, support by Hansen to allocate $300.00 for the program - Roll Call:  AYES:  Siderman, Kinzel, Cantrell, Pallin, Rank, Kilgus, Hansen - NAYES - NONE - MOTION CARRIED

Public Input:

Steve Wentworth - Sidewalk issue - charge the owners/businesses to shovel their sidewalks

Mike Bishop - Tell owners/shop owners that they must shovel the sidewalks letters have been distributed to all (owners & businesses)

Kilgus - Problem with paying Village Maintenance overtime

Discussion ensued

Jim Baltazar - Ordinance needed - already in place

Jim Kilgus - We agreed to pay Benzonia for re-assessments for the Village in a certain time frame - Rank - we have no response - a letter will be sent out - no funds till we have an answer
